Terms and Conditions

  1. These terms and conditions are between Davie Group Trading (Australia) Pty Ltd (ACN 646 762 745) (the Promoter) and you, the person participating in the Promotion (the Customer).
  2. Information on eligibility, mechanisms on how to participate, and the information in the Schedule form part of these Terms and Conditions. Participation in the Promotion is deemed acceptance of these Terms and Conditions.
  3. We reserve the right to alter or withdraw the Promotion at any time. Our decision is final in all matters relating to the Promotion.
  4. Subject to our Standard Terms and Conditions: Each offer applies to selected products and is subject to these Terms and Conditions and our Standard Terms and Conditions available at https://theoodie.co.uk/policies/terms-of-service. To the extent of any inconsistency between these Terms and Conditions and our Standard Terms and Conditions, these Terms and Conditions prevail.
  5. Promotional Period: The Promotional Period commences on the Start Date and concludes when stock is sold out or on any Revised End Date set by the Promoter, as set out in the Schedule.
  6. Eligibility: The Promotion is open to individuals who meet the Criteria in the Schedule. Participants must be aged 18 or over and resident in the United Kingdom at the time of participation. The Promoter reserves the right to cancel any order where it has reasonable grounds to believe the Customer does not meet the eligibility criteria.
  7. How to participate: Prior to the Promotional Period, the Customer must complete the sign-up form on the Promoter's landing page by submitting their email address (and, optionally, their phone number). Upon submission of the sign-up form, the Customer will be redirected to a confirmation page displaying a countdown timer, (the Confirmation Page), which the Customer should save. Customers who complete the sign-up form will receive a notification by email (and by SMS, if a phone number is provided) at approximately 24 hours and 2 hours before the promotion begins as a reminder, each of which will include a link to the Confirmation Page. Once the official sale begins at 7:00pm 4 November 2026 (GMT), the Confirmation Page will automatically redirect the Customer to the relevant sale landing page, where the Customer may have the opportunity to purchase the Eligible Product for £1 (GBP) in accordance with the access instructions provided. Access to the sale is strictly limited to Customers who have submitted the sign-up form and access the sale landing page via the Confirmation Page.
  8. Availability & Queue System: All offers under this Promotion are subject to availability. For the avoidance of doubt, completing the Promoter's sign-up form and receiving a notification does not guarantee the ability to purchase an Eligible Product at the Price. This Promotion is strictly limited to 1,000 units per Eligible Product (for a total of 3,000 units across 3 Eligible Products). A virtual queue system may be used to manage traffic. Entering the queue does not guarantee access to purchase the Eligible Product. Eligible Products are allocated to customers on a first-come, first-served basis at the time of checkout completion. If the Eligible Product sells out before checkout is finalised, the Promotion will no longer be available.
  9. One use per person: Each Customer may only purchase one (1) Eligible Product per order, but may otherwise purchase additional non-Eligible Products in the same cart or transaction. Any additional or suspicious orders may be cancelled.
  10. Verification of use: The Promoter reserves the right, at any time, to verify the validity of any Customer (including a Customer's identity, age and place of residence) and to cancel any order where multiple accounts, bots, automated systems or other unfair methods are used. Customers must provide accurate, complete and up-to-date information when completing the sign-up form and at all times during the Promotional Period. The Promoter reserves the right to cancel any order where inaccurate or misleading information has been provided.
  11. Application to orders: Only one offer can be used per order. It may not be used in conjunction with any other discounts, promotional codes or offers. Offers cannot be applied to existing orders.
  12. Expenses and delivery costs: Customers are responsible for any expenses incurred when participating in the Promotion. Standard UK shipping charges may apply and will be displayed at checkout. Where a Customer's order (including any non-Eligible Products purchased in the same transaction) meets the free shipping threshold displayed on the Promoter's website at the time of purchase, standard shipping charges will not apply to that order.
  13. No change-of-mind refunds: Subject to the Customer's statutory rights under the Consumer Rights Act 2015 and any other applicable UK consumer protection legislation (including the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013), the Customer will not be entitled to a refund due to change of mind where the Customer has purchased an Eligible Product as part of this Promotion. Nothing in these Terms and Conditions affects the Customer's statutory rights.
  14. Personal data: Your personal information is collected directly by the Promoter in Australia. As the Promoter offers goods and services to individuals in the United Kingdom, it is subject to the UK GDPR pursuant to Article 3(2) UK GDPR and processes your personal information in accordance with its obligations thereunder. The Promoter may share your personal information with its related entities and third-party service providers. Where the Promoter uses third party processors to process your personal information, it ensures that appropriate safeguards are in place in accordance with applicable UK GDPR requirements. The Promoter's appointed UK representative for data protection purposes pursuant to Article 27 UK GDPR is Davie Group Payments UK Limited (Company No. 16645993), c/o Buzzacott LLP, 130 Wood Street, London, EC2V 6DL (compliance@daviegroup.com.au). Data subjects and the Information Commissioner's Office may contact the UK representative directly in relation to any matter concerning the processing of personal data under these Terms and Conditions. You have the right to access, correct, or request deletion of your personal information, to withdraw your consent to marketing at any time, and to lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk. To exercise your rights, please contact us at help@theoodie.com. Personal information will be handled in accordance with the Promoter's UK Privacy Policy available at https://theoodie.co.uk/policies/privacy-policy.
  15. Marketing and Communications: By submitting the sign-up form, you consent to receive marketing communications from the Promoter by email and, if you provide your phone number, by SMS. These communications will include reminders about the Promotion and may include other news, offers, and updates from The Oodie. You may withdraw your consent and unsubscribe from marketing communications at any time by clicking the unsubscribe link in any email or by replying STOP to any SMS. Withdrawal of consent will not affect the lawfulness of any processing carried out before withdrawal.
  16. Non-Excludable Rights: Nothing in these Terms and Conditions limits, excludes, or modifies any rights or remedies that cannot be excluded or limited under applicable UK law, including the Consumer Rights Act 2015 and the Consumer Protection from Unfair Trading Regulations 2008 (Non-Excludable Rights). Any limitation or exclusion of liability in these Terms and Conditions applies only to the extent permitted by law. Nothing in this clause limits the Promoter's liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
  17. Consequential Loss: Despite anything to the contrary, to the maximum extent permitted by law, the Promoter will not be liable under these Terms and Conditions or otherwise for any special, indirect or consequential loss including but not limited to any loss of profit (including anticipated profit), benefit (including anticipated benefit), revenue, business, goodwill, opportunity, savings (including anticipated savings), reputation, use (including both real and anticipatory) and/or data, however arising, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.
  18. Liability: Except for any liability that cannot by law be excluded (including the Non-Excludable Rights), to the maximum extent permitted by law, the Promoter (including its officers, employees and agents) will not be liable to a Customer for all liability (including expenses, costs, damages, claims and losses) arising in any way out of or in connection with:
    1. any act or omission of the Customer;
    2. any breach of these Terms and Conditions by the Customer;
    3. any personal injury or loss (unless caused by the Promoter’s negligence or breach of duty);
    4. claiming the Promotion or any delay in being able to purchase the Eligible Product;
    5. any Promotion claim that is late, lost, altered, damaged, delayed or misdirected for reasons beyond the reasonable control of the Promoter; or
    6. any tax liability incurred by a Customer.
  19. Force Majeure: If performance of the Promotion, or any obligation under these Terms and Conditions is prevented, restricted, or interfered with by a Force Majeure Event, and as a result the Promoter is unable to carry out its obligations or provide the Customer with the Promotion (or any part of it), the Promoter may, to the extent reasonably necessary as a result of the Force Majeure Event and, subject to any applicable legislation, cancel, terminate, modify or suspend the Promotion and/or, if necessary, provide an alternative promotion to the same value. Force Majeure means any event or circumstance beyond the Promoter's reasonable control including, without limitation, acts of God, fire, explosion, vandalism, storm, orders or acts of military or civil authority, national emergencies, epidemics and pandemics, insurrections, riots, wars, strikes, lock-outs, work stoppages, terrorism, infection by computer virus, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion.
  20. Linked Sites: The platform for the Promotion may contain links to other websites (Linked Sites). The Promoter does not endorse and is not responsible for the content of any Linked Sites. Any Linked Sites displayed on the platform are for the Customer's convenience only and the Customer accesses and uses Linked Sites at their own risk.
  21. General: This Promotion has been designed to comply with the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing (CAP Code). This Promotion is open to UK residents aged 18 or over only.
  22. Currency: Unless the contrary intention appears, a reference in these Terms and Conditions or in any advertisement relating to the Promotion to pounds, GBP or £ is a reference to the lawful currency of the United Kingdom.
  23. Amendments: These Terms and Conditions may be amended or replaced from time to time if required by any regulatory authority.
  24. Complaints and Disputes: Any complaints relating to this Promotion should be directed to the Promoter at help@theoodie.com. The Promoter will endeavour to respond to all complaints within a reasonable time. Before commencing any legal proceedings, Customers are encouraged to contact the Promoter to seek resolution of any dispute. If the matter cannot be resolved directly, either party may propose resolution through a mutually agreed mediator, with the costs of mediation shared equally between the parties. Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from the courts. This Promotion is subject to the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing (CAP Code) administered by the Advertising Standards Authority (ASA). Complaints about the Promotion may also be referred to the ASA at asa.org.uk.
  25. Jurisdiction: These Terms and Conditions are governed by the laws of England and Wales. By participating in the Promotion, Customers submit to the non-exclusive jurisdiction of the courts of England and Wales. Nothing in this clause affects the statutory rights of Customers resident in Scotland or Northern Ireland under the laws applicable in those jurisdictions.
  26. Representations: To the maximum extent permitted by law, the Promoter excludes all warranties, guarantees or representations (whether express or implied) except as expressly provided in these Terms and Conditions.
